Thank you for visiting the Ramsgate Tunnels online shop (Ramsgatetunnels Shop).
These terms and conditions apply to the sale and purchase of tickets via Merlin Tickets.
Please read these terms and conditions carefully before ordering any tickets.
You should understand that by placing an order for any of our tickets you agree to be bound by these terms and conditions.
1. About us
1.1. Ramsgate Tunnels are operated by Ramsgate Heritage (Regeneration) Trust, a registered Charity (Charity number: 1170668). All profits generated by Ramsgate Tunnels are returned to Ramsgate Heritage Regeneration Trust to help support its work.
1.2. https://ramsgatetunnels.merlintickets.co.uk/ is the trading account operated by Ramsgate Heritage (Regeneration) Trust via the Merlin Tickets platform account. VAT Number: GB224476607. Our registered office is at: Ramsgate Tunnels, Marina Esplanade, Ramsgate, Kent, CT11 8FH.
2.1 References in these terms and conditions to ‘we’ or ‘us’ means The Ramsgate Heritage (Regeneration) Trust T/A Ramsgate Tunnels.
2.2. The definition of ticket is admission for a tour or event purchased and provided electronically via email to the registered address.
2.3. The definition of In Writing is information sent by Ramsgatetunnels Shop to the customer either in electronic form or sent by post.
2.4. The definition of Customer the person who concludes an agreement with Ramsgatetunnels Shop to provide admission tickets for various tours or events.
2.5. The definition of Booking Confirmation is written confirmation provided by Ramsgatetunnels Shop of the booking placed by the customer which is sent via email to the registered address.
3. Contract formation
All orders for tickets must be made online via https://ramsgatetunnels.merlintickets.co.uk/.
3.1 Your order is an offer to us to purchase the tickets subject to these terms and conditions and is subject to acceptance by us. Your order is only accepted by us and a contract formed between you (the Customer) and us for the purchase of tickets (the Contract) when we issue an e-mail confirming payment and containing e-tickets (the Booking Confirmation).
4.1. All tickets for tours offered on this website are subject to availability. Availability for tickets for any given tour or event will be reflected in the quantity available to book online.
4.2. If for any reason beyond our reasonable control we are unable to run the tour or event:
• We will notify you at the earliest opportunity by email to the email address you have provided to us, and/or by telephone – mobile or landline if these details have been provided to us.
• You will be refunded in full via the original payment method.
• Save in respect of death or personal injury caused by our negligence, our entire liability under or in connection with the Contract shall not in any event exceed the Price.
4.3. Specifications on the website for tours and events are meant as general descriptions and are not intended to be binding.
5. Pricing & Payment
5.1. The prices payable for the tickets are the prices set out on our website at the time that you place an order (the “Price”). The Price is quoted in £ (pounds sterling) and is exclusive of VAT at the time of writing.
5.2. We endeavour to ensure that all prices on our website are accurate. If, however, there is a pricing error we will inform you by email and:
• Where the correct price is lower, refund the difference;
• Where the correct price is higher, the customer will not be charged the difference.
5.3. We have no obligation to supply tickets to you at the incorrect price.
5.4. Payment can be made online using any of the following debit or credit cards:, Mastercard, Visa, Visa Delta, Visa Electron and Visa Purchasing. Payment is made via Worldpay via the Merlin Tickets platform account.
6. Returns Policy
6.1. Ramsgate Tunnels does not offer refunds on pre-booked tickets unless at least 48 hours advance notice is given in writing to email@example.com.
6.2. Ramsgate Tunnels will process the refund due to you as soon as possible and within 5 days of the notice of cancellation.
6.3. The refunded amount will be applied to the credit/debit card used for the original payment.
6.4. Confirmation of the refund will be sent in writing to the email address supplied at the time of the original booking.
7. Security and Privacy
7.1. Worldpay does not share your financial information with Ramsgate Tunnels or Merlin Tickets. Worldpay protects your financial information with industry leading security and fraud protect systems.
7.2. We do not store credit card details nor do we share customer details passed to us via the Ramsgatetunnels Shop platform with any other third parties.
8.2 Due to Coronavirus we may need to retain your details for NHS track and trace. By booking with this service you consent to us and/or our agent Merlin Tickets sharing your data with the NHS for this purpose.
9. Entire Agreement
9.1. These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior arrangement, understanding or arrangement between us, whether oral or in writing.
9.2. We and you each acknowledge that, in entering into a Contract, neither of us nor you has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us and you prior to such Contract except as expressly stated in these terms and conditions.
10. Right to Vary these Terms and Conditions.
10.1. We have the right to revise and amend these terms and conditions from time to time to reflect changes affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
10.2. You will be subject to the terms and conditions in force at the time that you order tickets from us, unless any change to these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to these terms and conditions before we send you the Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven (7) working days of receipt by you of the tickets).
11. Rights of Third Parties
Neither we nor you intend that any of these conditions should be enforceable, by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise, by any person who is not a party to the Contract.
12. Governing Law and Jurisdiction
12.1. These conditions and the Contract shall be governed by and construed in accordance with the laws of England and Wales.
12.2. If any of these conditions (or part thereof) is held by any court or other competent authority to be invalid, void or unenforceable it shall be deleted and the remaining conditions shall continue in full force and effect and if necessary be amended so far as may be required to give effect to these conditions.
